Wealthy AF Vault

1.  Overview of Empower Collective Pty Ltd.
   • Empower Collective Pty Ltd is an online business designed to provide group/individual coaching to women who want to reduce stress and overwhelm and eliminate self-doubt by developing an unshakable sense of self-worth so they can confidently speak their truth in a male-dominated society and set healthy boundaries without worrying what other people think.
   • Due to the coaching nature of this program, it is recommended that people with current mental health diagnoses that are being treated by a psychologist/psychiatrist do not enter the program without first consulting their treating practitioners. People receiving treatment for those diagnoses may not find this coaching program suitable or helpful, as it is not designed to be therapy or a replacement for therapy.
   • This coaching program was designed to utilise high quality, evidence-based psychological coaching, integrating techniques such as Cognitive Behaviour Therapy, Schema Therapy and Eye-Movement Desensitisation Reprocessing (EMDR).

2.  Structure of Wealthy AF Vault
   • The Membership requires a minimum one (1) month minimum commitment.
   • In each one (1) month block, you have access to:
     • An online membership portal where you can access on-demand video content of your choosing, based on available topics.
     • Any unused portions of the vault will be forfeited.

3.  Participation in the Wealthy AF Vault
   • Empower Collective Pty Ltd is operated by Eloise Tomkins. Eloise Tomkins is a registered
   • While Eloise Tomkins is a registered psychologist, the Wealthy AF Vault is not a psychology It is not a substitute for therapy, and participants must ensure that they continue to consult and engage with their treating practitioners to manage their own health.

• By consenting to participate in Wealthy AF Vault, you acknowledge that you are participating in a coaching program and are not receiving psychological services from Eloise Tomkins.
• To avoid any potential conflicts of interest arising, current psychology clients of Eloise Tomkins cannot be accepted as participants in this Wealthy AF Vault.
• Similarly, participants in any coaching programs cannot be accepted as psychology clients of Eloise Tomkins within a minimum of 6 months of completion of the Wealthy AF Vault.
• Any requests for cross-referral or registration between former psychology clients of Eloise Tomkins and this Empower Collective Pty Ltd will be assessed on a case-by-case basis, and will only be accepted at Eloise Tomkins’ discretion, depending on the individual circumstances.
• If, in the course of participating in this Wealthy AF Vault, issues arise which in Eloise Tomkins professional opinion are beyond the scope of the coaching relationship, a participant may be requested to see their general practitioner and obtain a referral to consult with an appropriate clinician.
• Eloise Tomkins may at any time and in their sole discretion, terminate a participant’s registration in the Wealthy AF Vault if Eloise Tomkins reasonably considers it appropriate to do so.
• In the event of termination of a participant’s registration in the Wealthy AF Vault, a partial refund of the participant’s fees (excluding administration fees) may be provided in Eloise Tomkins’ sole discretion, depending on the reason for termination.

2.  Privacy and Disclosure of Personal Information
   • As part of your participation in the Coaching Package, Empower Collective Pty Ltd needs to collect and record information from you.
   • We enclose a copy of our Privacy Policy, which we request you read and acknowledge your understanding of, prior to signing this document.
3.  Technology Requirements
   • This Wealthy AF Vault is provided online through Kajabi’s membership portal for the on-demand content, and videoconferencing for online coaching calls. You are responsible for the costs associated with setting up the technology needed so you can access online content and participate in video conferencing workshops.
   • To access the Wealthy AF Vault, you will need access to a microphone, video camera, and speakers, as well as access to a good internet connection.
   • During the vault sessions, you will require access to a quiet and private space, so you can fully engage in the content.
   • If these conditions are not met, the session may be unable to proceed and the session may be forfeited.
   •  The privacy of any form of communication via the internet is potentially vulnerable and limited by the security of the technology used.
4.  Fees
   • The Wealthy AF Vault is a membership subscription, where fees are payable on a monthly/quarterly or annual basis.
   • The Wealthy AF Vault fees are $67 AUD per month. All fees are in AUD and are inclusive of GST.
5.  Cancellation & Refund Policy
   • No refunds will be provided.
   • By joining the Wealthy AF Vault, you are signing up to a monthly subscription.
     • You must cancel your membership before your next renewal date to avoid being charged for the following monthly rate.
     • To cancel, please log into the Kajabi portal and access your settings.  You will receive a confirmation upon cancelling via email.  Please email us at [email protected] if you do not receive a confirmation of cancellation.
     • Access to the membership portal is contingent on having an active subscription. Your subscription will be revoked if payment is not current and access will granted when payment is paid in full.

6.  Intellectual Property
   • There is to be no reproduction, duplication, copying, selling, trading, reselling or exploitation for any commercial purposes, any portion of the Program (including course materials), use of the Program, or access to the Program.
   • Company’s copyrighted and original materials shall be provided to the Client for her individual use only and with a single-user, non-transferable, revocable license.
   • Client agrees that he/she will not use any of the Company’s intellectual property, including without limitation the Company’s copyrighted and original materials, for Client’s business purposes. 
   • Client shall not be authorized to share, copy, distribute, or otherwise disseminate any materials received from Company electronically or otherwise without the prior written consent of the Company. 
   • All intellectual property, including Company’s copyrighted course materials, shall remain the sole property of the Company. 
   • No license to sell or distribute Company’s materials is granted or implied by the enrollment or by the payment of any fees.
   • Client shall not join for the sole purpose of downloading all membership content and then requesting a refund or cancellation. 
   • Video content is not downloadable. The only content that can be downloaded are workbooks and resources. If we are notified that you are downloading the live workshops your access will be immediately revoked with no refunds given.
7.  Limited Liability
   • By enrolling in the Program and using Company’s services, Client releases Company, its officers, employees, directors, affiliates and related entities from any and all damages that may result from the provision of the services to the Client.
   • The Program is an educational/coaching service only.
   • Client agrees that she/they accepts any and all risks, foreseeable or non-foreseeable, arising from such services.
   • Client agrees that Company will not be held liable for any damages of any kind resulting or arising from the provision of the services including but not limited to; direct, indirect, incidental, special, negligent, consequential, or exemplary damages happening from the use or misuse of Company’s services or enrollment in the Program.
   • Client agrees that he/she uses Company’s services at Client’s own risk.
8.  Disclaimer of Guarantee
   • Client accepts and agrees that she/they are entirely and solely responsible for her/their progress and results from the Program.
   • Client accepts and agrees that Company cannot control the Client’s responses to the provision of the services under this Agreement.
   • Company makes no representations or guarantees whatsoever regarding performance of this Agreement other than those specifically stated herein. 
   • Company and its affiliates disclaim the implied warranties of titles, merchantability, and fitness for a particular purpose. 
   • Company makes no guarantee or warranty that the Program will meet Client’s requirements or that all clients will achieve the same or similar results.
9.  Confidentiality
   • The term “confidential” is defined as information which is not generally known to the public relating to personal or business affairs
   • Company will not disclose, reveal, or make use of any confidential information that is discussed during sessions with participants, during the coaching call or otherwise, without written consent from the participant.
   • However due to the group nature of the program and coaching calls being recorded for others to access at a later stage, it is up to the individual participants discretion on what they wish to disclose.

10.  Consent to participation in the EMDR Coaching Package
11.  I confirm that I have read and understood the information in this document about the Wealthy AF Vault and I acknowledge the following:
    • Empower Collective Pty Ltd is a coaching service. Although Eloise Tomkins is a registered psychologist, this is a coaching service, not a psychological service. I will not be receiving psychological services, treatment, advice or therapy in the course of my participating in the Individual Coaching Package;
    • I am not an existing client of Eloise Tomkins and I have not previously accessed psychological services provided by Eloise Tomkins within the last six (6) months;
    • As a result of my participation in the Wealthy AF Vault I am precluded from accessing psychological services provided by Eloise Tomkins for a minimum period of 6 months from the completion of this coaching service;
    • I acknowledge that I am engaging in the Wealthy AF Vault at my own risk, and that I fully release Eloise Tomkins and Empower Collective Pty Ltd, including its staff, officers and contractors, from any liability to the extent permitted by law; and
    • I have read and understood the Empower Collective Pty Ltd Privacy Policy. 

By clicking ‘I accept’, I acknowledge I have read and understood the information, terms and

conditions contained in this Consent Form and have discussed any outstanding questions with Eloise Tomkins.

I agree to the above conditions for coaching services to be provided to me by Empower Collective Pty Ltd.
